1 AREA OF ​​APPLICATION

These general terms and conditions of sale apply to all transactions between consumers and the Wolford Aktiengesellschaft joint stock company (company headquarters: Wolfordstrasse 1, 6901 Bregenz, Austria), which exist via the Wolford online shop (www.wolfordshop .be). The version applicable at the time of conclusion of the contract concerned is authoritative. Delivery of ordered goods is made exclusively to BELGIUM.

2 MINIMUM AND MAXIMUM ORDER AMOUNT

You have the possibility to purchase from the Wolford online store, up to a maximum total amount of €5,000.00, per order, with no minimum amount.

3 PRICES

For items ordered via the Wolford online store, only the prices that are mentioned in the shopping cart immediately before sending the order apply. Prices include value added tax for Belgium.

4 PARTICIPATION IN SHIPPING COSTS

When ordering less than 150 EUR in the WOLFORD online shop, a shipping cost of 3.90 EUR for standard shipping with DHL applies. In the event of a return, shipping costs incurred will not be refunded.

5 CONTRACT

Clicking the “send order” button completes the ordering process; you therefore accept the offer made by Wolford.

We confirm receipt of your order both on the following internet pages and by email.

We save the data relating to your order. If you wish to keep them, we invite you to print the confirmation page.

Wolford is entitled not to fulfill your order, in whole or in part, due to unforeseen difficulties with available stocks or a check revealing insolvency on your part. We will inform you by email within three working days following the discovery of such circumstances. We will of course refund any deposit you have paid for undelivered goods.

6 RESERVATION OF OWNERSHIP

We remain the owners of the goods until full payment of the sale price. You are required to treat the goods with care during the retention of title. You are obliged to inform us immediately in writing of any removal of the goods by a third party, in particular measures of forced execution as well as damage caused to the goods or their destruction.

We are entitled, in the event of non-compliance with the contractual clauses on your part, particularly in the event of late payment, to terminate the contract and take back the goods.

7 DELIVERY, TRANSFER OF RISK

Wolford ships all available items immediately upon receipt of your order and promises to deliver to you no later than 7 business days after your order.

By way of derogation from the above, Wolford mentions, where applicable, on the site, the items which cannot be delivered within the time limit referred to above and then specifies the maximum delivery time for the corresponding items. This information is brought to your attention before or at the time of your order.

If it is impossible to meet the deadlines mentioned above, due in particular to stock difficulties, we will contact you at the latest at the end of the announced deadline, in order to determine with you whether the order should be maintained. Wolford may offer you an equivalent item to replace the one ordered. Please note that you can obtain resolution of the sale and be reimbursed within 30 days of payment for your order.

We notify you by email when a shipment to you leaves our warehouse. You bear all risks of loss or theft of the goods from delivery.

The transfer of risk also takes place when you delay in accepting the goods.

8 PAYMENT

Different payment methods are available in the Wolford online store:

Credit card

If you decide to pay by credit card, Wolford will deduct the amount due from your current account after handing over the shipment to the courier. Like all other personal data, your credit card information is transferred securely (via SSL connection).

Payment on delivery

If you wish to pay on delivery, you bear the delivery costs which amount to 17.00 euros. These charges will be added to the amount of your order.

Advance payment

You can pay for your order in advance by transfer. We honor your order upon receipt of your payment.

9 WARRANTY AND DAMAGES

Wolford has been known for decades for its high-quality, reliable and comfortable products. Each item undergoes several thorough quality checks before leaving our premises.

We guarantee that the items delivered to you are free from any defects. The legal provisions relating to the guarantee apply. Minor differences in the goods, in particular minor color differences, do not constitute a defect triggering a warranty claim. In principle, you have the choice between modifying the order and an exchange. We are entitled to refuse the solution you have chosen if we cannot satisfy it or if it represents a disproportionate expense for us in comparison with other solutions. If a modification is neither possible nor appropriate, you can choose, in principle, between a reduction in price or requesting a cancellation of the sale as long as it is not a minor defect.

Wolford is only responsible for losses resulting from its direct personal action, to the exclusion of any loss which finds its origin directly or indirectly in a failure attributable to you, which comes from the act of a third party or from a case of force majeure.

10 RIGHT OF WITHDRAWAL

Right of withdrawal

You have the possibility of withdrawing without reason within fourteen calendar days in writing (e.g. letter, fax, email) or, when the goods have been handed over to you before the expiry of the period, by return of the merchandise. The period of 30 days begins to run from receipt of the goods by the recipient (in the case of successive deliveries of similar goods, from receipt of the first partial delivery). When the 30-day period expires on a Saturday, Sunday or public holiday, it is extended until the first following working day. Withdrawal implies the timely dispatch of the declaration of denunciation or the goods. The complaint must be communicated to:

In the event of valid denunciation, the services received by each party must be returned. If you are unable to return the service received to us in whole or in part or only in a degraded state, you must provide us with reimbursement if applicable. In the event of handing over the goods, this does not apply when the damage to the goods is due solely to its inspection - as could have happened to you in the store. Furthermore, you have the possibility of avoiding the obligation to reimburse for damage resulting from the correct putting into service of the goods by not using the goods as if they were your property and by refraining from any action which affects its value. Goods which can be sent by parcel must be returned at our risk.

Reimbursement obligations must be met within 30 days. The period begins for you when you send your declaration of denunciation or the goods, for us when we receive them.

In the event of a return, please note that we can only take back goods that were purchased via our Online Store.

To avoid any uncertainty about the legitimacy of the complaint, the items must be returned in their original packaging, undamaged and must not have been worn. A trial is possible as long as it is neither underwear nor hosiery.

So that we can improve our product range and the service of the Wolford online shop in the future, we kindly ask you to include the completed form with your return. Return costs are the responsibility of Wolford. You can use the enclosed return slip for your return.

Your personal data as well as all other information relating to your order will be encoded and transferred via a secure SSL connection. By placing an order in accordance with §5, you consent that the personal data concerning you, brought to the attention of Wolford within the framework of contractual relations, may be consulted, processed or used by Wolford as follows: we save your names and addresses as well as data relating to the order. We naturally guarantee the absolute protection of your personal data in accordance with the provisions of the Data Protection Act.

12 COMPENSATION, RETENTION AND ASSIGNMENT

You only have a right to compensation

if the company is unable to pay

for compensation claims that are legally linked to your debts, and

for compensation claims that have been judicially established or recognized by us.

You are entitled to exercise the right of retention only for those rights which are legally linked to Wolford's claims.

An assignment of your contractual rights to third parties is only possible with our written consent.

13 POSSIBILITY OF RESOLUTION OF DISPUTES ONLINE

14 FINAL PROVISIONS

Austrian law is exclusively applicable, excluding the United Nations Convention on the International Sale of Goods (CISG). The application of Austrian law does not result in depriving you of the protection afforded to you by the mandatory provisions of Belgian law as long as you have your habitual residence in Belgium and have completed the acts necessary for the conclusion of the contract. The place of payment and performance for all services is Bregenz.
