GENERAL CONTRACT CONDITIONS OF THE WOLFORD STORE FOR UNITED KINGDOM
In the Wolford online store you can purchase 24 hours a day: 24 hours a day, 7 days a week, directly on the website: www.wolford.com
For any questions you can send an email to: service.unitedkingdom@wolford.com
1. SCOPE OF APPLICATION
These General Contract Conditions apply to all business relationships between the consumer and Wolford Italia S.r.l., a limited liability company, with registered office in Corso Venezia 36, 20121, Milan, Italy (“Wolford”) which are initiated through the website www.wolford.com. The version accessible to the buyer and in force at the time of conclusion of the respective contract applies. The ordered goods are delivered exclusively within United Kingdom territory.
2. MINIMUM AND MAXIMUM ORDER VALUE
In the Wolford online shop it is possible to make purchases, without having to respect a minimum order value, up to a total value of the goods of GBP 5,000.00.
3. PRICES
Only the prices displayed in the shopping cart immediately before sending the order apply to items ordered in the Wolford online shop. Prices include VAT established by law.
4. SHIPPING COSTS
If the order placed in the WOLFORD online shop has a value of less than GBP 150, shipping costs of GBP 5.90 will be charged for standard shipping via DHL. In the event of a return, the shipping costs charged will not be refunded.
5. CONCLUSION OF THE CONTRACT
In our online shop you can place the desired products in a virtual shopping cart. Before sending the order we summarize the order details again. The consumer has the possibility to correct their data at any time by returning to the corresponding data entry page using the appropriate buttons. By clicking on the "Submit order" button at the end of the ordering process, the consumer submits a proposal for the conclusion of a purchase contract with Wolford.
Wolford confirms receipt of the order both on the website that opens subsequently and by e-mail. The aforementioned confirmation does not yet represent Wolford's acceptance of the consumer's proposal, but serves to inform him of the correct receipt of the information relating to the order.
Wolford stores the order data and contract contents in its archives. If the consumer wishes to keep his order data, he can print the confirmation page. For security reasons, order data is not accessible via the internet. It is also possible to download the General Contract Conditions at any time and save them in PDF format. The order can only be placed in English.
The contract between Wolford and the consumer is concluded with the sending of the ordered items to the consumer and the related communication by e-mail (acceptance). Wolford is required to accept or reject the contract proposal within five business days. The consumer will be informed of any non-acceptance of the proposal within three to five working days.
6. RETENTION OF TITLE
Wolford reserves the right to retain ownership of the goods until the entire purchase price has been paid. The consumer is obliged to treat the goods with care for the entire duration of the retention of title. The consumer must immediately inform Wolford in writing of all interventions by third parties on the goods, in particular, enforcement measures as well as damage or destruction of the goods.
If the consumer behaves contrary to the terms of the contract, in particular in the case of late payment, Wolford has the right to withdraw from the contract in accordance with the law and to demand the return of the goods.
7. DELIVERY
Wolford ships within United Kingdom territory via DHL. Normally the delivery time in United Kingdom is 3 – 4 days. Shipments are made Monday to Friday during normal business hours, excluding public holidays observed throughout United Kingdom. Please bear the above in mind when indicating your delivery address.
If certain items are not immediately available due to high demand, the Buyer can leave his email address so that we can be informed as soon as the goods are available.
8. PAYMENT
In particular circumstances Wolford reserves the right to offer only some of the payment methods indicated above for orders. In the Wolford online store you can pay comfortably and securely with the following methods: credit card (Visa, Mastercard, Diners, American Express), PayPal, Klarna, or other methods that will be applicable at check-out.
Credit card
The amount is charged to your credit card only when the order has been shipped. If the consumer returns one or more items, his credit card will be credited with the corresponding value of the goods that was originally charged.
PayPal
PayPal is a payment service from PayPal Inc., which allows users to make online payments. If the consumer makes the payment via PayPal, at the end of the ordering process, he or she is directed directly to the PayPal site where he or she can continue the transaction as a guest or with a registered account. Wolford usually registers receipt of payment within a few minutes and executes the order immediately. The consumer must agree to PayPal's terms and then accept PayPal's processes.
Bank transfer
Our bank details for bank transfers are as follows: Bank: Intesa San Paolo, BIC: BCITITMM, IBAN: IT37V0306909474100000018748, holder: Wolford Italia S.r.l.
9. MATERIAL DEFECTS
For decades, Wolford has been known for the high quality, reliability and portability of its products. Before being shipped, all items undergo numerous and careful quality checks.
Obviously the consumer can avail himself, without any limitation, of the rules on the legal guarantee. Slight differences in the goods, especially in colour, do not constitute a defect which gives the right to make a warranty claim.
10. RIGHT OF WITHDRAWAL REQUIRED BY LAW
The consumer has the right to withdraw from this contract within fourteen (14) days without having to indicate reasons. The withdrawal deadline is fourteen days from the day on which the buyer or a third party designated by him, other than the carrier, took possession of the goods. To exercise the right of withdrawal, the consumer must send an unequivocal declaration (e.g. letter sent by post, fax or e-mail) of his decision to withdraw from the contract to Wolford E-Commerce, c/o PVS Fulfillment-Service GmbH, Heinz-Nixdorf-Str. 2, 74172 Neckarsulm, Germany, e-mail: service.unitedkingdom@wolford.com. In the case of a return shipment, the consumer can use the return sticker that is attached to their order. To comply with the withdrawal deadline, it is sufficient to send the communication on the exercise of the right of withdrawal before the deadline expires. For hygienic reasons, the return of underwear and hosiery items which have been shipped sealed is excluded.
Consequences of withdrawal
If the consumer withdraws from this contract, Wolford is obliged to return to him immediately and, at the latest, within fourteen days all payments made by him and which Wolford has received starting from the day on which Wolford received the communication relating to his intention to withdraw from this contract. For this refund Wolford will use the same payment method used by the Buyer for the original transaction unless otherwise expressly agreed. Under no circumstances will Wolford charge the consumer any fees for the aforementioned reimbursement. Wolford may refuse to refund until it has received the goods or the Buyer has provided evidence that the goods have been sent back, whichever occurs first.
The goods must be returned or delivered immediately and in any case, at the latest, within fourteen days from the day on which the consumer communicates to Wolford his wish to withdraw from this contract to Wolford E-Commerce, c/o ITG Gmbh Intl. Spedition + Logistick, Eichenstraße 10a, 85445 Schwaig, Germany. The deadline is met if the consumer sends the goods before the expiry of fourteen days. Wolford bears the direct costs of return shipping. The consumer must be responsible for any loss of value of the goods only if this is attributable to processing that is not necessary to control the quality, characteristics and functionality of the same.
In the case of a return shipment, the consumer can use the return sticker that is attached to their order.
11. 30 DAY VOLUNTARY RETURNS GUARANTEE
For purchases in the online store, in addition to the right of withdrawal provided by law, Wolford also voluntarily grants the right of return for 30 days from receipt of the goods. Thanks to this voluntary right of return, the Buyer, even if the 14-day return period established by law has expired, can still withdraw from the contract by returning the goods received to Wolford within 30 days. Sending the goods within the 30 days granted is sufficient to comply with the deadline. In the case of a return shipment, the Buyer can use the return sticker attached to their order. If the Buyer makes use of the right of voluntary return, Wolford will refund him the amount of the return using the same payment method used by him.
The right of withdrawal provided for by law (see art. 10 Right of withdrawal provided for by law) is not affected by the 30-day voluntary right of return granted by Wolford contractually as a supplement and continues to be valid independently. Until the deadline for exercising the right of withdrawal provided for by law expires, the legal conditions contained in the instructions relating to withdrawal apply exclusively. The 30-day voluntary right of return granted by Wolford contractually does not limit the Buyer's legal warranty rights which remain unrestricted.

13. COMPENSATION, RIGHT OF RETENTION AND ASSIGNMENT
The consumer has a right to compensation only for claims that have been established by final judgment or are undisputed. If the right of retention is not based on the same contractual relationship, making a request to this effect is excluded. The assignment of contractual rights to third parties is only possible with the written consent of Wolford.
